Terms & Conditions
The Super Stuff – Super Contest" (hereinafter referred to as
"the offer") is valid from 15th June 2009 to 15th December 2009 (hereinafter
referred to as "the offer period"). The Organisers shall compose of
representatives of Audioworks Entertainment Private Limited.
1. Eligibility: Open to residents of
all countries. Employees & their immediate families (spouses, parents, children,
& siblings & their respective spouses) & those living in same household, of
Audioworks Entertainment Private Limited, each of its subsidiary companies and Project Support
Team & each of their respective parent companies, affiliates, distributors,
subsidiaries, & advertising/promotion agencies are not eligible to participate.

How to Enter: The participant has
to send a valid entry form to be eligible. There are no charges for
participation nor any purchase is required. The participant can send only one
entry form. If multiple entry forms are received from a participant, the
participant will be disqualified.
3. The subscriber who participates in
the "offer" during the "offer period" shall be eligible to become a part of a
lucky draw to win prizes to be conducted by the Organisers.
4. This offer is being made on a "best
effort" basis and participation is voluntary. Participation in this offer will
be construed as an acceptance of the terms and conditions stipulated herein.
5. Winner Selection: The winners are
auto-generated by the online application, picked at the end of the contest. The
online application queries the response list and picks the winner automatically.
The result announced shall be final and binding and no correspondence shall be
entertained.
6. Visa Charges: For 1st and 2nd prizes
Visa processing charges will have to be borne by the respective winners.
7. The participant must provide correct
contact information. In case of the same being wrong the Organisers shall not be
liable to give the prize to the contestant and the same shall stand forfeited.
8. The prizes to winners shall be given
subject to compliance with all formalities as required by the Organisers. Any
failure on the part of the winner(s) to comply with directions issued by
Organisers for claim of prize may result in the prize being declared null and
void.
9. To collect the prize the participant will
have to produce a valid passport / valid address proof and submit a self
attested copy of all the above to the designated place from where the Prizes are
to be collected. The winner / winners of the trips to London and Dubai will be
solely responsible for ensuring that he/she has valid passport, Visa and other
documents as may be required to go for the trip. The Visas have to be obtained
by the winners themselves.

Failure to avail / collect the
prize by January 30th, 2010 would result in the prize being declared null and
void and no prizes shall be awarded by the Organiser after this date.
11. No cash payment shall be made to the
consumer in lieu of offer prizes. The Organiser expressly states that the prizes
cannot be exchanged either for cash or in any other form. No reimbursement of
telephone charges/postal charges/courier charges, if any incurred, will be made.
12. The Organiser, reserves the right to
extend, cancel, discontinue, withdraw, change, alter or modify the terms of the
offer at its sole discretion without any notice at anytime during the validity
with or without notification and without assigning any reason. Decision of the
Organiser will be final and binding regarding this promotion, prizes and
parameter to decide the winner. No correspondence shall be entertained in this
regard.
13. The Organiser and its officers shall not
be responsible in any manner whatsoever for the manufacturing quality of the
prizes and or shall not be liable for any loss, damage, theft, breakage,
malfunction or any defect caused to or noticed in the prize and / or in respect
of the prize after handing over the same to the lucky winner that is offered.
14. By entering the contest or accepting a
prize, entrants consent to the collection, use, storage and distribution of
their personal information, including without limitation their name, address,
telephone number, age and/or photograph by the Organisers, in reference to all
matters related to this contest or in any publicity carried out by them without
compensation and agree to abide by the contest rules and the decisions of the
independent contest organization, and the Organiser, which are final. The
entrant's personal information may be provided to any third party by the
Organisers without the entrant's consent.
15. The Organiser will not be responsible for
any loss or damage suffered by the winner while availing the offer, during, or
after the promotion period.
16. All instructions, rules and conditions on
any advertising or promotional materials relating to the Scheme form part of
these provisions, provided that in the event of any conflict or inconsistency,
these provisions shall prevail over all such other instructions, rules and
conditions.
17. In case of any dispute or
difference in respect of the offer, the decision of the Organiser shall be final
and binding on all concerned.
18. All disputes are subject to exclusive
jurisdiction of Pune Courts only.
19. The Organiser is free to reproduce, use,
disclose and distribute any information / details of this scheme to third
parties without limitation. The Organiser reserves the right to publish the
photograph and / or name of the winner in promotional materials and
advertisements as it deems fit.
20. RELEASE AND INDEMNIFICATION: Audioworks Entertainment Private Limited reserves the right:
(a) To disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these terms and conditions.
(b) To decide whether a replacement
contestant should be selected in the event any entrant is disqualified from the
Contest.
21. By entering the contest, each entrant
releases and holds harmless the Organiser, prize suppliers, their respective
agents, representatives and associated companies, and all of their respective
directors, officers and employees from any and all liability for injuries, loss
or damage of any kind whatsoever including without limitation personal injury,
death or property damage resulting in whole or in part, directly or indirectly,
from acceptance, possession, use or misuse of any prize, participation in this
contest, or participation in any prize related activity and agrees to fully
indemnify the Organiser, prize suppliers, their respective agents,
representatives and associated companies, and all of their respective directors,
officers and employees from claims by third parties without limitation.
22. The winner shall be responsible for
any additional, incidental expenses required to be incurred to avail of the
prize. All taxes, insurances, transfers, spending money and other incidental and
related expenses as the case may be, unless specifically stated, are the sole
responsibility of the prize winner.
23. Prizes are non-transferable,
non-negotiable, subject to availability and there will be no cash alternative.
24. All entries become the property of the Organiser who assumes no responsibility for entries that are lost, late, delayed, destroyed or misdirected for any reason whatsoever or for any computer errors or malfunctions. Neither the Organiser, prize suppliers, or their respective agents shall be responsible for any errors, negligence, losses or damages of any nature whatsoever that may arise or occur in connection with this contest or a prize. The Organiser does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials / data that have been tampered with or altered are void. If for any reason, in the opinion of the Organiser, in its sole discretion, this contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of this contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, the Organiser reserves their right to cancel, terminate, modify, amend, extend or suspend this contest including canceling any method of entry. The Organiser reserves the right to modify the Contest Rules & Regulations. The Organiser reserves their right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the contest or to be acting in violation of the Contest Rules & Regulations or otherwise in a disruptive manner. Any attempts to deliberately damage any web site or to undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made the Sponsor reserves the right to seek remedies and damages to the fullest extent of the law. The Organiser shall not be held responsible for any errors or negligence that may arise or occur in connection with this contest including any damage to an entrant's computer equipment, system, software or any combination thereof, as a result of their participation in this contest or from downloading any material from the contest web site, where applicable. The Organiser may modify or withdraw this contest, without liability if any printing/production errors occur, without public notice.
